Agreement to Terms

By accessing or using the Biskit.Pet mobile application ("App," "Service," "Biskit.Pet"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Biskit.Pet.

These Terms constitute a legally binding agreement between you and Biskit.Pet.

1. Eligibility

1.1 Age Requirement

You must be at least 18 years old to use Biskit.Pet.

By creating an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws

1.2 Prohibited Users

You may not use Biskit.Pet if:

• You are under 18 years old
• You have been previously banned from Biskit.Pet
• You are prohibited by law from using the Service
• You intend to use the Service for illegal purposes

2. Account Registration

2.1 Account Creation

To use Biskit.Pet, you must:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access

2.2 Account Responsibility

You are responsible for:

• All activity that occurs under your account
• Maintaining the confidentiality of your login credentials
• Any content you post or messages you send

We are not liable for:

• Losses caused by unauthorized use of your account
• Actions taken by others using your account

2.3 One Account Per Person

• You may only create one account
• You may not create accounts on behalf of others without permission
• You may not transfer your account to another person

3. Acceptable Use

3.1 Permitted Uses

Biskit.Pet is intended for:

• Finding local pets for playdates and socialization
• Coordinating responsible breeding between pet owners
• Browsing and adopting pets from shelters, breeders, and individuals
• Rehoming your own pets responsibly

3.2 Prohibited Uses

You agree NOT to use Biskit.Pet to:

Illegal Activity:

• Violate any local, state, federal, or international law
• Sell animals prohibited by law
• Trade endangered species
• Facilitate animal fighting or abuse
• Sell stolen animals
• Evade animal welfare regulations

Animal Welfare Violations:

• Operate or promote puppy mills
• Sell animals under the legal minimum age (typically 8 weeks)
• Sell sick, injured, or abused animals without disclosure
• Breed animals inhumanely or excessively
• Neglect or abuse animals

Fraud & Scams:

• Post false or misleading information
• Misrepresent breed, age, health, or pedigree
• Engage in "bait and switch" tactics
• Request payment without delivering promised animals
• Impersonate other users or organizations

Harmful Conduct:

• Harass, threaten, or intimidate other users
• Post hate speech or discriminatory content
• Share sexually explicit or violent content
• Spam or send unsolicited commercial messages
• Hack, disrupt, or interfere with the Service

Intellectual Property Violations:

• Use copyrighted images without permission
• Impersonate brands or businesses
• Copy or scrape content from the App

3.3 Compliance with Laws

You agree to:

• Follow all applicable animal welfare laws
• Obtain necessary licenses or permits for breeding or selling
• Comply with local zoning and business regulations
• Pay applicable taxes on sales or transactions
• Follow health and safety requirements for animals

4. Content & User-Generated Material

4.1 Your Content

"Your Content" includes:

• Pet profiles and photos
• Adoption listings
• Messages
• Reports
• Any other material you submit

You retain ownership of Your Content.

4.2 License to Biskit.Pet

By posting Your Content, you grant Biskit.Pet a non-exclusive, royalty-free, worldwide license to:

• Display Your Content in the App
• Store Your Content on our servers
• Distribute Your Content to other users (as part of the Service)
• Modify Your Content for technical purposes (e.g., resizing images)

This license ends when you delete Your Content or your account (subject to backup retention).

4.3 Your Responsibilities

You represent and warrant that:

• You own Your Content or have permission to post it
• Your Content does not violate any laws
• Your Content does not infringe on others' rights (copyright, trademark, privacy)
• Your Content is accurate and not misleading
• Your photos depict the actual animals you are listing

4.4 Prohibited Content

You may not post content that:

• Contains nudity, sexual content, or pornography
• Depicts animal abuse or violence
• Contains hate speech or discriminatory language
• Infringes on intellectual property rights
• Is deceptive, fraudulent, or misleading
• Contains viruses or malicious code

4.5 Content Moderation

Biskit.Pet reserves the right to:

• Review, monitor, or remove Your Content at any time
• Suspend or terminate accounts that violate these Terms
• Cooperate with law enforcement regarding illegal content

We are not obligated to monitor all content, but we may do so.

5. Transactions Between Users

5.1 Third-Party Transactions

Biskit.Pet is a platform for connecting users. We do not:

• Sell animals
• Facilitate payments (currently)
• Guarantee the quality, safety, or legality of animals
• Act as a party to any transaction

All transactions are between users.

5.2 Your Responsibility as a Buyer/Adopter

Before adopting or purchasing an animal, you should:

• Meet the animal in person
• Request veterinary records
• Verify the seller's identity and reputation
• Get written agreements or contracts
• Report suspicious activity

Biskit.Pet is not responsible for:

• Fraud or misrepresentation by sellers
• Health or behavior problems with animals
• Disputes between buyers and sellers
• Failed transactions or refunds

5.3 Your Responsibility as a Seller/Breeder

If you list animals for adoption or sale, you must:

• Provide accurate information
• Disclose known health or behavioral issues
• Follow local laws and licensing requirements
• Ensure animals are healthy and of legal age
• Honor your agreements with buyers

Biskit.Pet may remove listings or suspend accounts that violate these requirements.

5.4 Shelter Accounts

Verified shelter accounts receive:

• FREE unlimited listings
• Verified badge
• Priority support

Shelters must:

• Provide proof of 501(c)(3) nonprofit status
• Follow all shelter and rescue regulations
• Accurately represent animals available for adoption

6. Fees & Payment (Future Feature)

Currently, Biskit.Pet is free to use.

6.1 Future Paid Features

We may introduce paid features in the future, such as:

• Premium subscriptions
• In-app transaction fees
• Promoted listings
• Breeder verification badges

We will notify you before implementing paid features.

6.2 Payment Terms (When Applicable)

If we introduce in-app payments:

• All fees will be clearly disclosed before purchase
• Payments will be processed through third-party providers (Stripe, PayPal, Apple/Google)
• Refunds will be subject to our refund policy
• You are responsible for applicable taxes

7. Intellectual Property

7.1 Biskit.Pet's IP

All content, features, and functionality of Biskit.Pet (excluding Your Content) are owned by Biskit.Pet and protected by copyright, trademark, and other laws.

This includes:

• The Biskit.Pet logo, name, and branding
• App design, layout, and user interface
• Code, algorithms, and software
• Text, graphics, and other materials

You may not:

• Copy, modify, or distribute our intellectual property
• Reverse engineer the App
• Use our trademarks without permission

7.2 License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use Biskit.Pet for personal, non-commercial purposes.

This license does not allow you to:

• Resell or commercialize the Service
• Create derivative works
• Use automated tools (bots, scrapers) without permission

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Key points:

• We collect email, location, pet info, and messages
• We do not sell your personal information
• You can delete your account and data anytime
• We comply with GDPR, CCPA, and other privacy laws

By using Biskit.Pet, you consent to our Privacy Policy.

9. Disclaimers & Limitations of Liability

9.1 "As Is" Disclaimer

We do not guarantee:

• Uninterrupted or error-free service
• Accuracy or reliability of content
• Security from hacks or data breaches
• Quality, safety, or legality of animals listed
• Truthfulness of user-generated content

9.2 No Responsibility for User Conduct

We are not responsible for:

• Actions or omissions of other users
• Fraud, scams, or misrepresentation by users
• Offline interactions or transactions
• Health, behavior, or condition of animals
• Violations of law by users

9.3 Limitation of Liability

This limitation applies even if we were advised of the possibility of such damages.

9.4 Indemnification

You agree to indemnify and hold harmless Biskit.Pet, its officers, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws
• Your Content or interactions with other users

10. Termination

10.1 Your Right to Terminate

You may delete your account at any time:

• Settings → Account → Delete Account
• Your data will be deleted within 30 days (see Privacy Policy)

10.2 Our Right to Terminate

We may suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Violation of our Community & Animal Welfare Policy
• Illegal activity
• Fraud or abuse
• Non-payment of fees (if applicable)
• Any reason at our sole discretion

10.3 Effect of Termination

Upon termination:

• Your license to use Biskit.Pet ends immediately
• You must cease all use of the Service
• We may delete Your Content (subject to backup retention)
• Sections 4.2, 8, 9, 10.3, 11, and 12 survive termination

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of [State/Country - to be determined at incorporation], without regard to conflict of law principles.

11.2 Arbitration Agreement

• Arbitration will be conducted by the American Arbitration Association (AAA)

• Small claims court (if the claim qualifies)

11.3 Class Action Waiver

All disputes must be brought individually, not as part of a class, consolidated, or representative action.

11.4 Informal Resolution

Before filing arbitration, you agree to:

3. Allow 30 days for us to attempt to resolve it

12. General Provisions

12.1 Changes to Terms

We may update these Terms from time to time. Changes are effective when posted.

We will notify you of significant changes:

• Email notification
• In-app notification
• Updated "Last Updated" date

Continued use after changes constitutes acceptance.

12.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

12.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

12.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without notice.

12.5 Entire Agreement

These Terms, along with our Privacy Policy and Community & Animal Welfare Policy, constitute the entire agreement between you and Biskit.Pet.

12.6 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control (natural disasters, pandemics, wars, etc.).

13. Apple & Google-Specific Terms

13.1 Apple App Store

If you download Biskit.Pet from the Apple App Store:

• These Terms are between you and Biskit.Pet, not Apple
• Apple is not responsible for the App or support
• Apple is a third-party beneficiary and may enforce these Terms
• You must comply with Apple's Terms of Service

13.2 Google Play Store

If you download Biskit.Pet from Google Play:

• These Terms are between you and Biskit.Pet, not Google
• Google is not responsible for the App or support
• You must comply with Google's Terms of Service
